Terms of Service

These Terms of Service ("Terms") govern your use of elimenti.com (the "Site"), operated by Elimenti ("Elimenti," "we," "us"), a web design studio based in Hinsdale, Illinois. By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
1. What these Terms cover
These Terms cover use of the Site only. They do not govern any design, development, Site Care, photography, or other work we do for clients. That work is governed solely by the written proposal or agreement signed for that project. If anything in these Terms conflicts with a signed client agreement, the signed agreement controls.
2. Inquiries, pricing, and proposals
Submitting the contact form, emailing us, or calling us does not create a contract or a client relationship, and it doesn't obligate either of us to start a project. A project begins only when both parties accept a written proposal or agreement.
Prices, rates, timelines, and service descriptions on the Site are general information. They may change at any time without notice and are not offers. The price, scope, and timeline for any project are the ones stated in its written proposal.
3. Using the Site
You may use the Site for lawful purposes, such as learning about our services and contacting us. You agree not to:
- submit false, misleading, or spam inquiries, or impersonate someone else;
- send malicious code or attempt to interfere with, overload, or gain unauthorized access to the Site or the systems behind it;
- scrape, copy, or harvest content or contact information from the Site through automated means; or
- use the Site in any way that violates applicable law.
4. Intellectual property
The Site's design, code, text, graphics, logo, and the name "Elimenti" belong to Elimenti and are protected by copyright, trademark, and other laws. You may view the Site and print or share pages for your own personal, non-commercial reference. You may not copy, reproduce, modify, or reuse the Site's design, code, or content for any other purpose without our written permission.
Portfolio work shown on the Site is displayed with our clients' permission. Client names, logos, photos, and trademarks belong to their respective owners, and their appearance on the Site doesn't grant you any right to use them. Ownership of work we build for a client is governed by that client's agreement, not by this section.
5. Third-party links and services
The Site links to websites we didn't build or don't control, including client sites and third-party services. We're not responsible for their content, availability, or privacy practices, and a link isn't an endorsement of everything on the other site.
6. Privacy
Our Privacy Policy explains what information we collect through the Site and how we use it.
7. Disclaimers
The Site and everything on it are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We work to keep the Site accurate and available, but we don't guarantee that it will be error-free, uninterrupted, or free of harmful components. Content on the Site is general information, not professional, legal, or business advice for your specific situation.
8. Limitation of liability
To the fullest extent permitted by law, Elimenti will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or business opportunities, arising out of or related to your use of, or inability to use, the Site. Our total liability for any claim arising out of or related to the Site or these Terms will not exceed one hundred U.S. dollars ($100). This section does not limit liability under any signed client agreement, which has its own terms.
9. Indemnification
You agree to indemnify and hold Elimenti harmless from any claims, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or your violation of these Terms.
10. Governing law and venue
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute arising out of or related to the Site or these Terms will be brought exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to the personal jurisdiction of those courts.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we'll post the new version on this page and change the effective date above. Your continued use of the Site after an update means you accept the revised Terms.
12. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms isn't a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and Elimenti about use of the Site; they do not replace or modify any signed client agreement.
